1. Service Description
AfriProtec ("the Service", "we", "us") is a cybersecurity intelligence platform operated by AfriProtec Ltd, a company incorporated in Kenya. The Service provides automated vulnerability scanning, threat intelligence, and security monitoring tools designed for businesses operating in Africa.
The Service includes web application scanning, network exposure analysis, dark web monitoring, AI-assisted security guidance, and related features as described on our website. Features and availability may change as the platform evolves.
2. Acceptable Use
By using AfriProtec you agree to use the Service only for lawful purposes and only against systems, domains, and networks that you own or have explicit written authorisation to test.
You must not:
- Scan, probe, or test systems without the owner's permission
- Use the Service to conduct denial-of-service attacks or disruptive testing
- Attempt to circumvent rate limits, authentication, or access controls
- Use the Service to assist in any illegal activity under Kenyan law or the laws of any jurisdiction where you operate
- Reverse-engineer, resell, or redistribute the Service without prior written consent
- Upload or submit malicious code, payloads, or content designed to harm AfriProtec systems
AfriProtec reserves the right to suspend or terminate accounts found in violation of these rules without notice.
3. Scan Limits and Fair Use
Each pricing tier includes a defined monthly scan allowance. Unused scans do not roll over to the next billing period. Scan limits are enforced per account and reset on the billing anniversary date.
- Free tier: Up to 3 scans per month on domains you own
- Professional tier: As specified in the current pricing schedule
- Enterprise tier: Custom limits negotiated in your service agreement
Automated bulk scanning, scripted API abuse, or any behaviour that imposes unreasonable load on our infrastructure may result in rate limiting or account suspension regardless of tier.
4. Payment Terms
Paid subscriptions are billed in advance on a monthly or annual basis in Kenyan Shillings (KES) or United States Dollars (USD) at your elected currency. All prices are exclusive of applicable taxes, including VAT where applicable.
- Payments are processed by our authorised payment processors. AfriProtec does not store full card details.
- Subscriptions renew automatically unless cancelled before the renewal date.
- Refunds are available within 7 days of the initial purchase if no scans have been consumed. No refunds are issued for partial billing periods.
- AfriProtec may update pricing with 30 days' notice to your registered email address. Continuing to use the Service after the effective date constitutes acceptance of the new pricing.
5. Data Handling
AfriProtec processes data you submit (scan targets, IP addresses, domain names, and resulting findings) to deliver the Service. Scan results are stored for 90 days and then permanently deleted unless you export them first.
We do not sell your data to third parties. Aggregate, anonymised statistics may be used to improve our threat intelligence models. Full details of how we collect, store, and process data are set out in our Privacy Policy.
6. Intellectual Property
All software, algorithms, threat-intelligence data, and content making up the AfriProtec platform are the intellectual property of AfriProtec Ltd or its licensors. Nothing in these Terms transfers any ownership rights to you.
You retain ownership of data you upload or generate through your use of the Service. You grant AfriProtec a limited licence to process that data solely to provide the Service to you.
7. Disclaimer and Limitation of Liability
The Service is provided "as is" and "as available." AfriProtec makes no warranties, express or implied, regarding the completeness, accuracy, or fitness for a particular purpose of scan results or security recommendations.
Security scanning is inherently probabilistic. AfriProtec does not guarantee that scans will identify every vulnerability in a system. Findings should be treated as guidance, not as a comprehensive security audit.
To the fullest extent permitted by applicable law, AfriProtec's total aggregate liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid to AfriProtec in the 3 months preceding the event giving rise to the claim.
AfriProtec is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, even if advised of the possibility of such damages.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict-of-law principles. You irrevocably submit to the exclusive jurisdiction of the courts of Kenya for any dispute arising under or in connection with these Terms.
9. Dispute Resolution
Before initiating formal proceedings, both parties agree to attempt to resolve any dispute in good faith through direct negotiation for a period of 30 days from written notice of the dispute.
If the dispute is not resolved through negotiation, it shall be referred to and finally resolved by arbitration in Nairobi, Kenya, administered under the Nairobi Centre for International Arbitration (NCIA) rules in force at the time of submission. The language of arbitration shall be English. The arbitral award shall be final and binding.
Nothing in this clause prevents either party from seeking urgent injunctive or other interim relief from a court of competent jurisdiction.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you by email or by posting a notice within the platform at least 14 days before material changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance.
